Baxter Springs Police Chief defends report on baby eating edible marijuana candies

Edible Update -

It is unfortunate that I even have to add to our earlier post but since some people not present at the scene appear to think this post is about marijuana rights or an attempt to slander parents, Allow me to clarify.

First, whether a person believes it is right or not, any form of marijuana, including edibles is against the law in Kansas and Baxter Springs.

Having such edibles located where a child can get ahold of it is a legal form of child endangerment.

Any possible charges forthcoming will be dealt with appropriately as it was at the time this occurred.










Using compassion, we allowed all family members to focus on their child at this time and not be worried about misdemeanor charges. The time for that will be when the child is safe and recovered fully. The hospital reported this incident to the proper authorities at the state level, as did the BSPD and this case is still open.

The simple facts which are always recorded are this:

Parents called 911 and reported their child had ingested some form of drugs. This was the information dispatched out to Police, Fire and EMS.

Upon arrival, and I was actually there, we found the child unresponsive and breath sounds were undetectable. Another officer and I lay on the floor with him, giving external chest rubs and cleared his airway of red mucous which also ran down his face.

The parent of the child brought us the package of edibles and told us the child had eaten some but not a lot.







My sergeant carried the boy, still limp and unresponsive, to the ambulance to allow for a quick transition. He drove the ambulance to allow both medical officers the ability to work on the child in transport.

We allowed parents to go be with their child and did not hold them up at the scene. Any criminal issues could be dealt with at a later time. The edibles and vape liquid was seized as evidence.

What happened in the emergency room, I can’t say and I will not comment on something that I cannot testify as being truthful.

The hospital and the BSPD contacted the Department of Children and Family Services which is required by law for both to do. Any local charges will be reviewed by the BSPD and prosecutor.

We are absolutely thrilled that this child is doing fine. 

Every single word of the original post was true and verifiable by video and audio recordings. Not one single word in any post was leveled at shaming anyone nor did we say what medical reports would be. The facts were stated. 

We will certainly not apologize for stating fact. We will not attempt to defend the practice of having legal or illegal drugs left accessible to children and this post is not about debating marijuana law. Until it changes, we will continue to enforce it.

People that were not there will continue trying to make law enforcement look bad or be a nay sayer. I can only report what actually happened because I was there.

I write the majority of posts on this page as the Chief of Police. There is always a fine line between reporting information which should be posted for public viewing and information that should not. 

The post regarding this matter was true, verifiable and meant to keep it from happening to anyone else. In this case the marijuana may or may not be a contributing cause.

There are evidently other issues causing the child to seize and lose consciousness. The fact remains that parents told us the child had eaten some illegal drug and told us there was no medical issues up until that point. 










I am glad if the drug had nothing to do with it and we will discover that with the release of medical records, which will not be posted here. However, the fear of the parents that this was the cause was more than enough cause to warn others to keep their drugs locked up and away from children.

Since there were no names mentioned in our post, of child or residents of the home, I find it difficult for anyone to believe the intent was to shame the parents of this child.

Accept it or not, it’s up to the reader. Yet I hope others will take the advice and make sure that harmful items are kept away from the reach of children. 

Even things such as bleach or other cleaning liquids should be kept out of reach. This case just happened to be edibles but we would have posted the same thing if a child had taken a drink of drain cleaner kept under your bathroom sink, it’s all about informing our community to take precautions to save the lives of their loved ones. That’s it, that’s all there is to it.
