Joplin man to be sentenced Friday after pleading guilty to aggravated assault of a law enforcement officer

This month, our office filed 30 criminal cases, 22 felonies and 8 misdemeanors. The following is a summary of felony convictions and prison sentences obtained this month.

Eugene Alberty, 51, of Joplin, Missouri, plead guilty to two counts of aggravated assault of a law enforcement officer, fleeing or attempting to elude law enforcement, and driving while suspended.

In May 2018, Alberty was pursued into Cherokee County by deputies from Ottawa County, Oklahoma.

During the pursuit, Alberty drove his vehicle and oncoming traffic as well as pursuing law enforcement officers. Cherokee County Deputies successfully deployed stop sticks on US Highway 400. Alberty was taken into custody a short time later by Cherokee County deputies and officer with the Baxter Springs Police Department. Alberty will be sentenced in Cherokee County District Court on February 15, 2019.

Fredrick “Eddy” Sears, 48, of Columbus, plead guilty to possession of methamphetamine with intent to distribute and unlawful cultivation of marijuana. Sears will be sentenced in Cherokee County District Court on March 5, 2019.

Ronald Rex Lomax, 53, of Pittsburg, plead guilty to attempted aggravated burglary, aggravated assault, and contributing to a child’s misconduct or deprivation.

In March 2017, Lomax, along with another adult male, Erik Jones, and a juvenile female went to a residence in West Mineral armed with weapons.

While attempting to enter the residence, Jones received a fatal gunshot wound. Lomax will be sentencing in Cherokee County District Court on April 1, 2019.

Jeffery Qualls, 45, of Galena, was sentenced to 36 months in the Kansas Department of Corrections for possession of methamphetamine with intent to distribute.

Qualls was arrested by Galena Police Officers in 2017 while in possession of a large quantity of methamphetamine. Qualls entered a guilty plea in 2018 in lieu of trial.

Collin Gepford, 39, of Pittsburg, plead guilty to fleeing or attempting to elude law enforcement.

In November 2018, Gepford was pursued into Cherokee County by deputies from Barton County, Missouri. Gepford was eventually stopped and taken into custody by Cherokee County deputies. Gepford will be sentenced in Cherokee County District Court on February 11, 2019.

Adam Wiles, 30, of Joplin, Missouri, plea no contest to burglary of a non-dwelling and aggravated assault. In September 2018, a Cherokee County resident observed a suspect enter a barn on his property.

When confronted by the resident, the suspect brandished a handgun. The resident, who was also armed, fired a single round of 20 gauge birdshot, striking the suspect. Investigators with the Cherokee County Sheriff’s Office subsequently identified Wiles as the suspect.

Jason Arthur Wright, 44, of Baxter Springs, plead guilty to aggravated child endangerment and battery of a law enforcement officer. January 1, 2019, Cherokee County Deputies responded to a domestic disturbance near Baxter Springs.

Deputies learned Wright had been physically violent toward his domestic partner, and other household members.

When deputies attempted to arrest Wright, he became combative, but was eventually taken into custody. Wright will be sentenced in Cherokee County District Court on March 8, 2019.

Jerrod Pierce, 26, of Seneca, Missouri, plead guilty to felony theft of a motor vehicle. In July 2017, Pierce stole a vehicle from a residence in Galena.

Later the same day, Pierce was apprehended in the vehicle, following a pursuit by Cherokee County Deputies. Pierce will be sentenced in Cherokee County District Court on February 15, 2019.
Joshua Seal, 33, of Columbus, plead guilty to felony criminal threat. In June 2018, Seal threatened to commit acts of violence against employees at Downstream Casino. Seal will be sentenced in Cherokee County District Court on March 4, 2019.

Christopher Cleave, 32, of Joplin, Missouri, was ordered to serve a 120-day sanction in the Kansas Department of Corrections for absconding from probation. Cleave was on probation for possession of methamphetamine in 2017.

Charles Steele, 33, of Joplin, Missouri, was ordered to serve a 120-day sanction in the Kansas Department of Corrections for absconding from probation. Steele has been on felony probation since being convicted of interference with law enforcement in 2016.

Bobby Gene Cope, 40, of Joplin, Missouri, was ordered to serve 29 months in the Kansas Department of Correction for violating the conditions of his probation. Cope has been on felony probation since being convicted of Interference with law enforcement in 2016.

Wesley Foster, 28, of Quapaw, Oklahoma, was ordered to serve 12 months in the Kansas Department of Corrections for violating the conditions of his probation. Foster has been on felony probation since being convicted of burglary in 2016.
