Oklahoma man charged with murder after DWI accident on probation for DWI

A Tuttle, Okla. man who was allegedly driving drunk when a passenger in his car was killed Saturday, was already on probation for another drunk driving conviction.

McDonald County Circuit Court online records show Daxton S. Harrison, 21, was arrested May 27, 2012, for driving while intoxicated. He was given a suspended sentence, attended a victims impact panel, was sentenced to community service, which he did not complete, and given two days of shock time in the county jail.

Court records indicate that Harrison was placed on unsupervised probation for two years, with the probation scheduled to conclude July 16.

Felony second degree murder and felony driving while intoxicated charges were filed against Harrison, as well as careless and imprudent driving and not wearing a seatbelt. Judge John LePage set Harrison's bond at $25,000, cash only.

According to the Highway Patrol report, the accident occurred when a westbound 2013 Toyota Corolla driven by Harrison, 21, dropped off the edge of the roadway, overcorrected and struck an embankment.

A passenger in the Harrison car, Heather M. Garrett, 20, Rogers, was pronounced dead at the scene by McDonald County Deputy Coroner Tracy Dowd.

Harrison was taken to Freeman West, Joplin, for treatment of minor injuries.
