(From the Sarcoxie Police Department)On 11-10-21, Chief Corum was notified at 0200 of a careless and imprudent driver exiting I-44 at Exit 22.
Chief traveled down west Blackberry to make sure the vehicle hadn't crashed or caused a crash, but the vehicle was located near CR 70 and Blackberry Road headed east. The vehicle was swerving and coming into the oncoming lane of traffic. Chief turned around on the vehicle and observed their driving. The vehicle went back into the oncoming lane of traffic.
A traffic stop was initiated at 37 Highway and Blackberry Road. Contact was made with Manuel Gallardo-Vasquez, of Fayetteville, AR. It was clear that the driver was intoxicated.
He was asked to step out of his vehicle to perform a portable breath test (PBT). Gallardo-Vasquez blew a 0.272% BAC.
Gallardo-Vasquez was arrested for driving while intoxicated and was transported to the Jasper County Detention Center.
Gallardo-Vasquez consented to a breath test where his BAC was confirmed to be 0.243%.
Gallardo-Vasquez also was found to have an outstanding warrant from Taney County, MO, from 2007 for Driving Under Influence.
Charges of DWI, Driving without a Valid Driver's License, and Driving on the wrong side of the Roadway are pending with the Jasper County Prosecutor's Office.
Gallardo-Vasquez is innocent until proven guilty by the courts.
PBT's are not able to be used in court. They are used to determine the preliminary BAC and so that we can get you medically cleared.
It's a good thing he was arrested for DUI before causing an accident. Having to fightDUIcharges of being 3 times over the legal limit is often a felony DUI offense in many states today. Hopefully this person will learn from this and never driver under the influence again.
